Terms and Conditions of Sale

By placing your order with Simply Digital, you accept the following Terms and Conditions:

1. Pricing

Our products and prices are subject to change. Promotional terms only apply in the period stated for the promotion. Whilst we will try to ensure that prices on the website are accurate, we are not responsible for errors that may occur. If we discover any errors in the price of goods before we accept your order, we will notify you as soon as possible and give you the option to resubmit your order at the correct price or cancel the order. The price of all goods and services advertised are inclusive of any applicable taxes including VAT.

2. Availability

All goods and services are subject to availability. Any product stock or availability information supplied on the website is an estimate only.

3. Delivery

Charges for delivery are not included in the stated product price - see Delivery for details of applicable charges. Delivery can be made to addresses in the to UK or Europe.

4. Ordering

To order goods through this website you must be at least 18 years of age. Any e-mail or other electronic acknowledgement by us of receipt of an order placed by you does not constitute legal acceptance by Simply Digital of your order. All orders are subject to approval by us. When processing your order, the information provided will be subject to credit and fraud prevention checks. For these purposes we may transfer your information to trusted third parties.

5. Returns and Refunds

FAULTY GOODS

Within 28 days of receipt

If your purchase develops a fault within 28 days of receipt, we will generally exchange or refund the item provided it is in 'as-new' condition. We will collect the product from you for inspection. This does not apply to faults caused by accident, neglect or misuse, for which there will be no refund or exchange.

Outside 28 days of receipt

If your purchase develops a fault after 28 days and within its 12 month guarantee period you will be responsible for returning the product to us, we will arrange to repair and return the product to you free of charge ( UK only). This does not apply to faults caused by accident, neglect or misuse for which there can be no refund or exchange.

DAMAGED GOODS

Please try to check your delivery on receipt. If signing for goods that are damaged please sign as "damaged", or "unchecked" if you're not able to check at the time of delivery.

In the unlikely event your order is received damaged please contact us immediately. Please retain the original packaging for returning your order. Contact us with your Simply Digital order number and with details of the problem and from where and when the returned parcel can be conveniently collected. We will arrange to replace or refund your order, whichever your preference. It is your responsibility to notify us of any incorrect goods supplied within 7 days of delivery.

UNWANTED GOODS

Within 21 days of receipt.

Provided your purchase remains unused and 'as new' we will accept the product back for a full refund up to 21 days after purchase without question. This refund does not extend to the cost of delivery or return and your product will need to be inspected before reimbursement.

SHORTAGES

It is your responsibility to sign for the correct number of packages as shown on the carrier's delivery consignment note. Any shortages must be noted on the consignment note and it will be your responsibility to notify us within 7 days of delivery.

INCORRECT GOODS

It is your responsibility to notify us of any incorrect goods supplied within 7 days of delivery.

This policy does not affect your statutory rights.

6. Website Information

Any goods, services or information displayed on this website should not be regarded as an offer, invitation, solicitation, advice or recommendation to buy products or services on the website. No warranties or representations are made about any goods other than as expressly contained in this Website. To the extent permissible by law all implied terms, whether by statute or otherwise, are excluded.

7. Liability

Simply Digital’s liability for any injury (other than death or personal injury), damage or loss, in particular consequential loss, arising from the use of any goods purchased via this website, or from the transaction itself, are hereby excluded. Any injury, damage or loss arising directly from the negligence of Simply Digital or any of its agents will be limited to a refund of the value of the goods purchased, together with any delivery charges paid.

8. Security

While all reasonable care is taken to protect the confidentiality of your credit card details, Simply Digital cannot be liable if, through no fault of its own, these details are intercepted by and used by third parties. All personal details are handled in accordance with the Data Protection Act 1998 and our own Privacy Policy.
